Important: Please read these Terms of Service carefully before using MarrowMind. By creating an account or using the app, you agree to be bound by these terms. If you do not agree, do not use MarrowMind.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Empire Eats Games LLC ("Company," "we," "us," or "our"), a company registered in the United States, governing your use of the MarrowMind mobile application ("App"), website (marrowmind.com), and all related services (collectively, the "Service").

By accessing or using the Service, you confirm that you are at least 13 years of age (or 16 in the EEA), have read and understood these Terms, and agree to be bound by them and our Privacy Policy.

2. Description of Service

MarrowMind is a daily mental wellness utility application that provides tools including Quick Reset, Box Breathing, Grounding exercises, Mood Check-In, Journaling, and AI-assisted Chat. The Service is intended for general wellness and self-help purposes only.

Not a Medical Service: MarrowMind is NOT a medical device, mental health treatment service, therapy platform, or crisis intervention service. Content in the App is not a substitute for professional medical advice, diagnosis, or treatment. The AI chat feature does not constitute therapy or counseling. Always seek the advice of a qualified mental health professional for any mental health concerns. If you are in crisis, contact emergency services (911) or the 988 Suicide & Crisis Lifeline.

3. Account Registration

To use most features of MarrowMind, you must create an account. You agree to:

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Subscription Terms and Billing

4.1 Subscription Tiers and Pricing

MarrowMind offers the following subscription plans, in addition to a free tier. All prices are in USD (United States Dollars):

Prices may vary by region and are subject to applicable taxes. We will provide at least 30 days' notice of any price increases to existing subscribers.

4.2 Billing and Payment Processors

Subscriptions may be purchased through the following channels. Each channel uses a designated payment processor:

Subscription fees are billed in advance at the start of each billing period (weekly, monthly, or annual). All fees are non-refundable except as required by applicable law or as described in our Refund & Cancellation Policy.

4.3 Subscription Entitlement Management via RevenueCat

Across all purchase channels, MarrowMind uses RevenueCat, Inc. as our subscription entitlement management platform. RevenueCat validates purchases made through Apple, Google, and Stripe; grants or revokes access to paid features based on your current subscription status; and synchronizes your entitlements across platforms and devices. Your anonymous App User ID (derived from your Firebase account) is shared with RevenueCat solely to enable entitlement management. RevenueCat does not receive your journal entries, mood data, or chat messages.

4.4 Auto-Renewal

All subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date (for App Store / Play Store purchases) or at least 24 hours before renewal (for web purchases). You authorize us (or the applicable platform) to charge the applicable subscription fee to your payment method on renewal.

4.5 Free Trials

We may offer free trial periods at our discretion. If a free trial is offered, you will not be charged until the trial period ends. You may cancel at any time during the trial period to avoid charges. After the trial, you will be automatically charged the subscription fee unless cancelled.

4.6 Cancellation

Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date. We do not provide pro-rated refunds for unused portions of a billing period, except as required by law.

4.7 Refunds

For App Store purchases, refund requests must be submitted to Apple. For Google Play purchases, refund requests must be submitted to Google. For website purchases via Stripe, refund requests must be submitted to us at here-to-support@marrowmind.com within 14 days of purchase. Refunds are issued at our sole discretion except where required by applicable consumer protection law.

4.8 Usage Limits

Paid subscriptions are subject to the following daily AI chat message limits:

Daily message counters reset at midnight UTC. Unused messages do not roll over. These limits are enforced server-side and may not be circumvented.

5. Acceptable Use Policy

You agree to use MarrowMind only for lawful purposes and in accordance with these Terms. You agree NOT to:

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

6. AI Chat Feature — Important Limitations

The AI chat feature is powered by large language model technology and is provided for general wellness conversation and support only. It is not therapy, counseling, or clinical mental health treatment. AI responses may be inaccurate, incomplete, or inappropriate. Do not make medical, legal, or financial decisions based solely on AI chat responses. In a mental health emergency, contact 911 or call/text 988.

7. Intellectual Property

The Service and all content within it — including but not limited to text, graphics, logos, UI design, software, and audio — are owned by or licensed to Empire Eats Games LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial wellness purposes only. This license does not include the right to copy, modify, distribute, sell, or sublicense any part of the Service.

You retain ownership of the content you create within the App (journal entries, mood logs). By using the Service, you grant us a limited license to store and process that content solely to provide the Service to you.

8. Account Deletion

You may delete your account at any time through the in-app account deletion feature (Settings → Account → Delete Account) or by emailing here-to-support@marrowmind.com. Account deletion is permanent and irreversible. See our Privacy Policy Section 10 for full details on data deletion timelines.

Per Apple App Store and Google Play Store requirements, we provide an in-app account deletion mechanism. Active subscriptions must be cancelled separately through the applicable platform or our website before account deletion.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any of the following reasons:

Upon termination, your right to use the Service immediately ceases. If we terminate your account without cause, we will provide a pro-rated refund for any prepaid subscription period.

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT IN THE SERVICE, INCLUDING AI-GENERATED RESPONSES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMPIRE EATS GAMES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations on certain warranties or liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Empire Eats Games LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Empire Eats Games LLC is registered, without regard to conflict of law provisions.

Any dispute arising from these Terms or the Service that cannot be resolved informally shall be subject to binding individual arbitration in accordance with the American Arbitration Association's consumer rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date, send an email notification to registered users, and display an in-app notice. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.

14. Third-Party Services

The Service integrates with third-party services including Apple App Store, Google Play Store, Firebase (Google LLC), RevenueCat, Inc., Stripe, Inc., and OpenAI, L.L.C. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of these third parties.
